Former Congressman’s 10-Year Sentence for Lobbying Venezuelan Government

David Rivera, a former U.S. Representative from Florida, was sentenced to 10 years in federal prison for his involvement in a $50 million covert lobbying initiative on behalf of the Venezuelan government during Donald Trump’s presidency. His sentencing took place on Friday in federal court in Downtown Miami following a jury’s unanimous guilty verdict on all counts in May.

Since the guilty verdict was made public on May 1, Rivera had been in federal custody without bail. Originally, the sentencing date was set for July 20, but it was postponed until October 2.

Rivera faced a statutory maximum sentence of 60 years and potential fines amounting to $20 million in asset forfeiture. His actions were labeled a significant betrayal by federal officials, especially considering the backgrounds of many South Floridians who fled oppressive regimes.

Federal Officials Condemn Rivera’s Actions

Following the sentencing, U.S. Attorney for the Southern District of Florida, Jason A. Reding Quiñones, condemned Rivera’s actions as a serious betrayal of the South Florida community, a region that is home to many who escaped tyranny.

“He sold his reputation to communists to fill his greed,” Reding Quiñones emphasized, underscoring the gravity of the betrayal. He added, “For many families here, communism is not an economic idea or chapter in a book; it means murder, torture, political prisoners, families divided, and people forced to leave their homeland for political freedom.”

Brett Skiles from the FBI’s Miami Field Office reiterated that operating covertly for a foreign government has serious consequences, while Charles Miller of the IRS’s Criminal Investigation division stressed that political status does not exempt individuals from accountability.

Details of the Conviction

Rivera was convicted on multiple counts, including failing to register as a foreign agent under the Justice Department and conspiracy to engage in money laundering. Esther Nuhfer, a political consultant tried alongside Rivera, was also found guilty on all counts.

Prosecutors alleged Rivera and Nuhfer collaborated with the Venezuelan government, specifically under Nicolás Maduro, between 2017 and 2018, facilitated by a multiyear contract with Rivera’s consulting firm.

Allegations of Undermining U.S. Policy

The charges stemmed from an 11-count indictment filed in 2022, stating that Rivera was recruited by then-Venezuelan Foreign Minister Delcy Rodríguez to leverage his Republican ties to influence U.S. policy and advocate for softened sanctions against Venezuela. Rivera and Nuhfer are accused of concealing their relationship with officials such as Marco Rubio and Texas Congressman Pete Sessions while receiving substantial payments from a U.S.-based affiliate of PDVSA, Venezuela’s state oil company.

“As long as the money kept coming in, they didn’t care from where,” said prosecutor Roger Cruz in his closing arguments.

Evidence showed Rivera used encrypted messages and code words to discuss sensitive operational details, indicating an intent to obscure their involvement. For instance, Maduro was referred to as the “bus driver,” and significant monetary transactions were referred to as “melons.”

Defense Claims

In his defense, Rivera’s team argued that his actions aimed to remove Maduro from power, suggesting that the activities under the $50 million contract should be considered commercial rather than political and thus exempt from registration as a foreign agent.

During the trial, testimony was presented from notable politicians, including Rubio and Sessions, who claimed they were unaware of Rivera’s consulting deal with the PDVSA affiliate.

Rivera’s congressional career was brief, serving just one term after his election in 2010, and he had previously held a significant position in the Florida Legislature. His relationship with Marco Rubio dates back to their shared time in Tallahassee.

Contributors to this report include Jacob Rosen, Steven Yablonski, and Marybel Rodriguez.
