Proposed Tax Amendment: Impact on Cryptocurrency Trading in France
Concerns Over Impact on Trading
The recent proposal to amend tax regulations in France has raised significant concerns among stakeholders regarding its potential effects on trading dynamics. Francois Volpoet, the regional sales director for Chainalysis in France, expressed worries that this amendment could inadvertently drive investors toward decentralized finance (DeFi) platforms, peer-to-peer transactions, and offshore exchanges that operate outside the purview of international tax-reporting obligations.
Regulatory Scrutiny and Implementation Questions
Public Accounts Minister David Amiel has also voiced reservations about the proposed changes. He called for a reexamination of the amendment, suggesting that it might be premature to implement such significant alterations. “We first need to define stablecoins, then ensure our ability to monitor and trace reallocations within a portfolio of assets,” Amiel stated during a recent parliamentary session.
Finance Committee’s Position on Deferral
In light of the volatile nature of cryptocurrencies, Philippe Juvin, the rapporteur general for the finance committee, has indicated a preference for postponing the voting on the amendment. He believes that the current state of the crypto market warrants a cautious approach before making sweeping changes to taxation laws.
Changes to Capital Gains Calculation
One of the key elements of the proposed amendment involves altering the method for calculating capital gains on cryptocurrency transactions. Instead of using a portfolio-wide approach, the new framework would base calculations on the acquisition costs of the assets sold, implementing a weighted average for units of the same cryptocurrency purchased at varying prices. This shift aims to provide a more accurate reflection of gains and losses, aligning taxation closer with actual investment performance.
