OCC Implements GENIUS Act for Stablecoin Regulation
The Office of the Comptroller of the Currency (OCC) has unveiled a final rule that implements the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act. This key legislative framework aims to establish a regulatory environment for payment stablecoins in the evolving digital currency landscape.
A Historic Step in Financial Regulation
This initiative is seen as a pivotal moment in the U.S. financial system. U.S. Secretary of the Treasury Scott Bessent remarked, “The GENIUS Act marks a watershed moment in American finance, further cementing the United States as the crypto capital of the world.” He continued by drawing parallels to the National Currency Act of 1863, which constituted a foundational legal structure for bank-issued currency, suggesting that the GENIUS Act serves a similar purpose for stablecoins today.
Framework for Innovation and Compliance
Comptroller of the Currency Jonathan V. Gould emphasized the importance of this final rule in fostering innovation within the financial sector. He stated, “Today’s final rule advances President Trump and Secretary Bessent’s vision for American leadership in digital assets.” The guidelines lay out stringent standards for reserve backing, redemption, and risk management for permissible stablecoin issuers.
Key Features of the Final Rule
The final rule articulates specific requirements for both domestic and foreign payment stablecoin issuers operating under the OCC’s jurisdiction. Additionally, it governs certain custody activities engaged in by OCC-supervised institutions. Notably, the agency’s rulemaking aligns with the mandates of the GENIUS Act, excluding provisions associated with anti-money laundering, the Bank Secrecy Act, and Office of Foreign Asset Control sanctions, which will be addressed in subsequent regulations.
Stakeholder Engagement and Future Steps
In formulating the final rule, the OCC received extensive feedback from diverse stakeholders, including cryptocurrency companies, community bankers, and academic experts. The agency is committed to collaborating with other regulatory bodies to ensure comprehensive implementation of the GENIUS Act.
The OCC also announced that it will share further information regarding the acceptance and processing of applications and waiver requests for prospective payment stablecoin issuers in an upcoming release. As the stablecoin market continues to develop, the OCC is prepared to adjust its supervisory and regulatory frameworks as necessary.
Effective Date
The provisions set forth in the final rule and the GENIUS Act will come into effect on January 18, 2027.
